Can my Heirs pay the Inheritance tax due from my estate?
No, in the UK the estate pays any inheritance tax due and then the estate is divided accordingly. In Spain, each Inheritor has to pay the tax due before they can dispose of any assets.
I have my pension paid into a bank account in the UK. Do I have to receive the pension in Spain because it is liable for tax there?
Where you receive the pension is irrelevant, the pension is declared for tax purposes in Spain to the Spanish Tax Agency, but you can receive the pension payment in a bank in the UK or anywhere else for that matter.
I am a pensioner and a resident of Spain. Can I choose whether to pay tax in Spain or in the UK ?
No, you cannot choose, the Double Taxation Agreement between Spain and the UK establishes what income is liable to tax in Spain and what income is liable for tax in the UK. By following what is set out in this agreement your tax affairs will be in order with both countries.
